Old Opera House Mystery (Alva's First Homicide - 9 November 1910) Order Extending Time To
Prepare and Serve Case Made State of Oklahoma, Plaintiff
vs. -- Case 714 Woodward Co., OK
N. L. Miller, Defendant Now, to-wit, on this the 15th day of September, A.D. 1911, the same being
one of the regular judicial days of the Adjourned July 1911 Term of said
District Court, this cause came on for hearing upon the application and
request of Defendant N. L. Miller, made in open court for an extension of
time within which to prepare and serve a case made in said cause to apeal
said cause to the Criminal Court of Appeals of the State of Oklahoma, the
State of Oklahoma, being present by Sandor J. Vigg, County Attorney of Woods
County, State of Oklahoma, and the Defendant being present in person and
by Charles Swindall, his Attorney, and the court being fully advised in
the premises both as to the law and the facts and for good cause shown it
is by the Court, considered, ordered and adjudged that the said Defendant,
N. L. Miller, be and he hereby is granted and allowed, Sixty days within
which to prepare and serve a case made upon the County Attorney of Woods
County, State of Oklahoma, and said County Attorney of Woods County, State
of Oklahoma, is allowed and granted twenty days within which to to suggest
amendments to said case-made, said case made to be settled and signed upon
five days written Notice from either party to the other. It is further ordered by the court that said appeal be perfected and filed
in the Criminal court of Appeals of the State of Oklahoma, within One Hundred
and Seventy days after this date, unless other-wise ordered by the court
or a judge thereof, by way of extension of time.
